Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the tallytoday mobile app and website (the “Service”), operated by Alex Andrews, doing business as tallytoday (“tallytoday,” “we,” “us”). By creating an account or using the Service, you agree to these Terms.

Who can use the Service

You must be at least 18 years old and able to enter into a binding contract. The Service is intended for business use by contractors, their employees, and contract workers. If you register on behalf of a company, you represent that you are authorized to bind that company to these Terms.

Accounts

An “Admin” creates a company account and invites Workers to join it. Admins are responsible for the accuracy of information entered by their company, for controlling who has access, and for complying with applicable labor, wage, and privacy laws in their jurisdiction.

You are responsible for keeping your password secure and for all activity that occurs under your account. Notify us at support@tallytoday.com if you suspect unauthorized access.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Upload content that infringes intellectual property, is defamatory, or violates another person's privacy.
  • Attempt to probe, scan, reverse-engineer, or disrupt the Service.
  • Use automated means to access the Service except through our public APIs, if any.
  • Misrepresent time worked, falsify records, log overlapping or impossible shifts, or otherwise use the Service to deceive a payer or another party. The Service automatically flags overlapping shifts for the same Worker; submitting overlapping logs is a violation of these Terms regardless of whether the Service surfaces the conflict.

Your content

You retain ownership of the information you submit to the Service — time logs, projects, schedules, clients, receipts, photos, and other content (“Your Content”). You grant us a non-exclusive license to host, display, and process Your Content solely to operate and improve the Service.

Pay calculations and overtime

The Service calculates weekly pay totals from the time logs and pay rates entered by your company's Admin. When the Admin enables the optional overtime rule, hours worked past 40 in a Mon–Sun week are paid at the configured multiplier (defaulting to 1.5×) on the Worker's base rate. To prevent retroactive changes to already- completed weeks, the rule applies only to weeks starting on or after the date the Admin turned the rule on.

Pay totals shown by the Service are estimates produced from the data in your account. They are not legally binding payroll outputs. Your company is solely responsible for actual payroll, tax, and labor- law compliance, including the correctness of pay rates, overtime rules, classification of Workers, and final paycheck calculations.

Subscription and billing

The Service is currently offered on a trial basis. When paid plans are introduced, pricing and billing terms will be disclosed at signup. If you subscribe to a paid plan, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. Fees are non-refundable except as required by law.

Free trial

We may offer a free trial. At the end of the trial, your access to the Service may be suspended or require a paid subscription. We will notify you before any charge.

Account termination and data deletion

You may delete your account at any time from within the app. Workers delete their own account from the Settings tab. Admins can delete the entire company from the Settings page on the web dashboard or the admin Settings sheet on mobile.

Account deletion is a two-step process. Once deletion is requested, the account is immediately locked and removed from active use. You then have a 30-day restore window during which you can sign in, confirm your identity, and reverse the deletion. After 30 days, the account is permanently purged: personal information is removed or anonymized, and the account record cannot be recovered.

We may suspend or terminate your access if you violate these Terms.

Service changes and availability

We may add, change, or remove features at any time. We aim to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance or make changes that temporarily limit access.

Third-party services

The Service relies on third-party providers (such as Supabase, Resend, Expo, Vercel, Apple, Google, Open-Meteo, and Photon / OpenStreetMap). Your use of the Service may also be subject to those providers' terms. We are not responsible for third-party services.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

tallytoday is a tool to help you track time and organize work. You are responsible for using it correctly and for ensuring your business practices comply with applicable laws, including wage, hour, tax, and privacy laws.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALLYTODAY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 IF YOU HAVE NOT PAID US.

Indemnification

You agree to indemnify and hold harmless tallytoday from any claims, damages, or costs arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

Governing law and disputes

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to the exclusive jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
